These terms govern your use of Trustlee's document organisation and family heritage workshop services. Please read them at your own pace before engaging our services.
1. Definitions
Throughout these Terms, the following words carry the meanings set out below:
- "Trustlee" / "we" / "us" / "our" — refers to Trustlee, operating at 8 Jalan Padungan, 93100 Kuching, Sarawak, Malaysia.
- "Service" — refers to any document organisation visit, heritage workshop, or multi-session programme offered by Trustlee.
- "User" / "you" / "your" — any individual or household that accesses this website or engages our Services.
- "Content" — any text, images, materials, or information on this website or provided during sessions.
- "Agreement" — these Terms & Conditions in their current published form.
- "Session" — a scheduled visit or workshop appointment.
2. Acceptance of Terms
By making an enquiry, booking a session, or using this website, you confirm that:
- You are at least 18 years of age, or have the consent of a parent or guardian.
- You have the legal capacity to enter into this Agreement.
- You have read and understood these Terms.
- You agree to be bound by them in their current form.
If you do not agree with any part of these Terms, please refrain from using our Services or this website.
3. Service Description
Trustlee provides three document organisation and heritage workshop services to households in Malaysia:
Family Records Visit — RM 500
A companion visit assisting a household in laying out personal records into a labelled folder set. The session is informational and organisational in nature only. No opinions are offered on legal positions or asset matters.
Heritage Reference Workshop — RM 1,350
A small workshop helping families build a printed reference of where heritage materials — photographs, letters, certificates, and keepsakes — are located. Conducted as labelling and reference work only.
Heritage Records Programme — RM 4,250
A multi-session programme spanning several weeks covering inventory, labelling, scanning checklists, family-meeting agenda templates, and a final heritage handbook. Educational and archival in scope.
Our Services are available to households in Sarawak, Malaysia. We reserve the right to decline or reschedule service requests at our reasonable discretion.
4. User Responsibilities
When engaging our Services or using this website, you agree to:
- Provide accurate and complete contact information when making enquiries.
- Be available or arrange access at the agreed session time.
- Not use any content from our website for commercial redistribution without written consent.
- Not misrepresent your identity or the purpose of your enquiry.
- Treat our staff with courtesy and professionalism during all sessions.
- Notify us at least 48 hours in advance if you need to reschedule a booked session.
You acknowledge that Trustlee's services are organisational and educational in nature and do not constitute legal, financial, or professional advisory services of any kind.
5. Intellectual Property
All content on this website — including text, design, icons, workshop materials, templates, and the printed heritage handbook — is the intellectual property of Trustlee unless otherwise indicated.
We grant you a limited, non-exclusive, non-transferable licence to use workshop materials delivered to you during your session for personal, household use only. This licence does not permit:
- Commercial use or resale of any materials.
- Reproduction or distribution to third parties without written consent.
- Modification or adaptation of materials for publication.
Personal documents and records you bring to a session remain entirely your own. Trustlee holds no claim over your family documents or records at any time.
6. Payment Terms
All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise.
- Payment timing: Full payment is required prior to or at the commencement of the session, unless a written instalment arrangement has been agreed.
- Payment methods: Bank transfer, cash, and other methods as communicated at the time of booking.
- Cancellations by client: Cancellations made more than 48 hours before a session will receive a full refund. Cancellations within 48 hours may be subject to a partial fee at our discretion.
- Cancellations by Trustlee: If we need to reschedule a session, we will offer a full refund or an alternative date.
- Multi-session programme: The Heritage Records Programme fee may be paid in agreed stages. Partial programme completion does not entitle a proportional refund of remaining sessions once materials have been delivered.
7. Session Terms
The following conditions apply to all booked sessions:
- Scope: Each session is limited to the organisational and archival activities described in the service. No opinions on legal, financial, or tax matters will be given at any time.
- Duration: Session lengths are approximate. We will not rush through agreed activities, but extended overruns may need to be rescheduled.
- Materials: Folder kits, printed index pages, and draft binders are provided as part of the service and are included in the quoted fee.
- Confidentiality: We treat all documents, photographs, and household records with discretion. No copies are made or retained by Trustlee without your explicit written consent.
- Programme pacing: The Heritage Records Programme proceeds over several weeks. Session scheduling is agreed in advance and adjusted collaboratively.
8. Disclaimers
Trustlee's services are provided on an "as available" basis for organisational and educational purposes only.
- We do not offer legal, financial, tax, estate planning, or professional advisory services. Nothing shared during a session constitutes advice of this nature.
- We make no representations about the completeness, suitability, or adequacy of any folder system or archival approach for any specific legal or financial purpose.
- The information on this website is general and informational in nature. It is not a substitute for independent professional advice.
- Trustlee is not responsible for the condition, accuracy, or completeness of documents you bring to a session.
9. Limitation of Liability
To the extent permitted by Malaysian law:
- Trustlee's total liability for any claim arising from a session or this website shall not exceed the fee paid for the session in question.
- We are not liable for indirect, incidental, or consequential losses, including loss of documents not caused by our direct negligence.
- We are not liable for outcomes arising from your reliance on our organisational work in a legal, financial, or estate capacity.
- Force majeure events — including natural disasters, health emergencies, or infrastructure disruptions — may delay or cancel sessions without liability to either party.
10. Indemnification
You agree to hold harmless and indemnify Trustlee, its staff, and associates from any claims, losses, or costs arising from your misuse of our Services, provision of inaccurate information, or violation of these Terms. This includes reasonable legal fees incurred in defending such claims.
11. Termination
Either party may end a service engagement at any time by providing written notice. On termination:
- Any fees paid for completed sessions are non-refundable.
- Fees paid for undelivered future sessions will be refunded within 14 business days.
- Materials already delivered to you remain yours to keep.
- Provisions regarding intellectual property, disclaimers, and liability survive termination.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of any dispute:
- Step 1 — Informal resolution: Contact us at [email protected] and describe the matter. We will respond within 10 business days and make a genuine effort to resolve the issue.
- Step 2 — Mediation: If informal resolution fails, either party may refer the matter to a mediator agreed upon by both parties.
- Step 3 — Courts: Unresolved disputes will be subject to the exclusive jurisdiction of the courts of Sarawak, Malaysia.
13. General Provisions
- Entire Agreement: These Terms, together with any written booking confirmation, represent the full agreement between you and Trustlee regarding the subject matter.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign ours to a successor entity.
- Notices: Formal notices to Trustlee should be sent to [email protected] or to our address at 8 Jalan Padungan, 93100 Kuching, Sarawak.
14. Changes to Terms
We may update these Terms from time to time to reflect changes in our services or in applicable law. When we do:
- The revised Terms will be published on this page with an updated "Last Updated" date.
- For material changes, we will notify you by email if you have an active booking.
- Continued use of our Services after the effective date of changes constitutes acceptance.
